This is not a hot top in law. In fact, it is probably one of the most mundane issues you will read about but it is extremely important. Deeds, whether they are cash warranty deeds (deeds with a guarantee), quitclaim deeds, (no guarantee) or donations (gifts to another) are means of transferring property. They are basically structured the same however in Louisiana you need some key elements. A seller or donor in the case of a donation. A buyer or done in the case of a donation. Addresses for all involved and A property description The legal language that conveys the property is generally something of the following: Seller Who declared that they do by the presents, GRANT BARGAIN, SELL, CONVEY AND DELIVER, with full guarantee of title, and with complete transfer and subrogation of all rights and actions of warranty against all former proprietors of the property herein conveyed, together with all rights of prescription, whether acquisitive or liberative, to which said vendors may be entitled unto: Buyer This is language generally associated with cash warranty deeds that transfer the rights of another in a property to another person. You will see that the language itself states that the Seller is conveying to the other party all rights. This is a special type of power and when dealing with land that is an incredible right. When I file a deed into the Clerk of Court, it goes into the Public Record of that area. Whether you live in a Parish or a County. From there that deed will go to your local tax assessor for purposes of changing the name of the owner of that property. After all of that, you will be sent a tax notice IF and only IF you are not homesteaded in paying property taxes. A deed is the fundamental aspect of our life in the USA!
